Attorney-Prepared Letters of Demand
Accurate, strategic pre-litigation correspondence.
A letter of demand should state a verified claim accurately, comply with applicable notice requirements and support a real recovery strategy. It may prompt payment, a dispute response or negotiation — but it cannot guarantee recovery.
Overview
What Is a Letter of Demand?
A letter of demand formally communicates a claim, its basis, amount or required performance, due status, response requirement and intended next step.
A demand is not a court order, does not itself guarantee payment or judgment, does not automatically prove the debt, and may not interrupt prescription merely because it was sent. It should never threaten steps the creditor does not intend or cannot lawfully take.
Final legal statements must be reviewed for your specific South African context.
When to Send a Demand
When Should a Creditor Consider a Demand?
A demand is not always the required or best first action — urgency, prescription, insolvency and security may call for another route.
Getting It Right the First Time
Template Risk and What We Verify First
Template Risk
Why a Template Can Weaken the Creditor's Position
A generic or inaccurate demand can carry the wrong legal identity, incorrect amount, missing notice requirements, admissions, threats of unavailable remedies or prescription assumptions. We do not offer an editable legal template as a substitute for review.
What We Review First
Verify the Claim Before Demanding Payment
We confirm correct parties and authority, the agreement and terms, performance and delivery, amount and reconciliation, due date and breach, prescription and urgency, and debtor status and recoverability.
Documents Required
Documents to Prepare for a Demand Assessment

Components of an Effective Demand
What a Proper Demand Should Address
We do not publish a one-size-fits-all demand body on this page — every demand is built around your claim.
What the Contract and Numbers Require
Notice Clauses, Amount and Interest
Notice Clauses
The Contract May Control How Notice Must Be Given
Agreements may specify addresses, delivery methods, notice periods, remedy opportunities or arbitration clauses. We do not assume email or WhatsApp is valid service for every contractual notice, and we verify what the agreement and law permit.
Amount & Interest
Demand Only What Can Be Supported
Principal, interest, charges and legal fees need a documented contractual, statutory, tariff or order basis. We do not add one interest rate universally, and we preserve a calculation audit trail for every claim.
Delivery & Proof
Send the Demand Through
the Correct Channel
Delivery method depends on the agreement, law, strategy and intended next step. Reliable records of sending, delivery, refusal or response may matter — we do not state that an ordinary email or post record automatically proves valid receipt or service.
Debtor Responses
The Response Determines the Next Strategy
What Happens Next
Settlement Terms and an Ignored Demand
Negotiated Settlement
Document Any Agreement Properly
A repayment or settlement should define amount, dates, interest and cost treatment, authority, security, default, acceleration and full-and-final settlement status where relevant — not an informal promise.
If the Demand Is Ignored
No Response Does Not Automatically Mean Judgment
We assess whether evidence, amount, jurisdiction, debtor status, costs and recoverability justify proceedings. An ignored letter never authorises self-help, blacklisting or seizure.
Prescription
A Demand May Not Protect
a Claim From Prescription
Prescription periods and interruption depend on debt type, facts and law. Sending a letter of demand does not universally interrupt prescription — where timing may be critical, please call us directly rather than relying on a website enquiry.

Do I need an attorney to send one?
Not every demand legally requires an attorney, but review can protect accuracy and strategy.
What documents should I provide?
Agreement, invoice, delivery and correspondence records, submitted through a secure process.
How much time should a demand give the debtor?
This depends on the contract, law and facts — there is no universal period.
Does a demand interrupt prescription?
Not universally. This requires matter-specific legal review.
What if the debtor disputes the claim?
We assess the evidence and may route the matter to litigation.
What happens if the letter is ignored?

How much does an attorney demand letter cost?
Cost depends on claim complexity, review, calculations and urgency — discussed during your assessment.
